Emotional support animals should be allowed to have reasonable access to common space. The answer to your specific question would depend on whether limiting ESA owners to just that space is reasonable and whether there are any genuine safety or health reasons for doing so.

I have been her for over year no issues. There is an area approximately 5′ x 10′ area that is not very well kept, designated for dogs. I generally walk my dog on the side walk and try to make him go to that area but he refuses to enter that area sometimes. I recently heard there are letters circulating the complex stating we cannot walk the dogs anywhere but the designated area. If we do not abide we will be fined and eventually be taken to court and billed for court costs. Is this legal?? What if anything can I do?

We believe the exemption you’re referring to is the one for owner-occupied buildings with no more than four units. These residences are not obligated to comply with ESA accommodation rules, but can do so voluntarily.

According to FHA regulation 803(b)2 my property is exempt from FHA rules but my tenant insists I am and has brought a dog into their unit. If I’m exempt, can they force me to accept the pet anyway? They are threatening to sue

This article although from 2020 is still about the latest ESA law in Florida. ESA owners are still protected in Florida as long as they have a valid ESA letter from a licensed healthcare professional.

Landlords must accept valid ESA letters that are signed by licensed healthcare professionals. They cannot make up their own form requirements.

They wont accept signed letter from doctor. They want seperate doc signed by doctor stating the esa is required to live etc. is this normal?
